Stocks looked poised for a mostly flat open on Monday, following last week�� pain.

J.C.Penney (JCP) was climbing 5.5% in pre-market trading on the news that Home Depot (HD) executive Marvin Ellison will take over as chief executive next year, succeeding current CEO Myron E. Ullman III. However, it was also downgraded to Sell at UBS today, with a $5 price target.

Canadian Pacific Railway (CP) wants to merge with CSX Corp. (CSX), a combination hat would unite two of North America�� largest railroad operators. Shareholders seem to like the plan too, sending the stocks up 2.4% and 11%, respectively,

General Electric�� (GE) aircraft leasing unit, GE Capital Aviation Services, agreed to buy Dublin-based helicopter lessor Milestone Aviation Group for $1.775 billion.

Targa Resources Partners (NGLS) is buying the oil and gas limited partnerships Atlas Pipeline Partners (APL) and Atlas Energy�(ATLS), sending the shares of both stocks up double digits.

Also, the Nobel Prize in economics was awarded today to Jean Tirole, a French economist whose theories about the behavior of large companies underpin modern antitrust regulation.

    One interesting battle that's playing out in the grocery industry is the collection of purchase data through loyalty cards. SUPERVALU and Kroger (NYSE: KR  ) have both tried to flesh out and expand their loyalty systems in order to hold off competition from non-traditional competitors like big-box retail stores, and Safeway (NYSE: SWY  ) CEO Steve Burd said earlier this year that its shelf-pricing will be "irrelevant because we can be so personalized in what we offer people."     Investors looking for a bank further down the line might want to look into Credit Suisse (NYSE: CS  ) . The Swiss bank also reported today, but the news was weighted on the positive side. Revenue and income both increased, and the bank has recently taken on some wealth management opportunities while shedding riskier private equity operations. While the bank still has some troubles to overcome -- it was recently admonished for its high pay -- there's a lot to like at Credit Suisse�these days.�

The U.S. Justice Department is preparing to file civil fraud charges against Citigroup and Bank of America's Merrill Lynch unit over their sale of flawed mortgage securities ahead of the financial crisis, according to people familiar with the probes. Civil investigators have compiled evidence that allegedly shows that investors lost tens of billions of dollars after purchasing securities Citigroup (C) had marketed as safe even though the bank had reason to believe otherwise, one person said. An investigation into the mortgage securities marketed by Merrill Lynch, which Bank of America (BAC) agreed to acquire at the height of the crisis in 2008, is also close to completion, two other people said. Probes against Royal Bank of Scotland (RBS) and Credit Suisse (CS) are also underway and progressing, according to another two people familiar with those cases. Representatives for all four banks declined to comment. The U.S. banking industry, which faces a range of mortgage-related lawsuits, has contended that many of the alleged investor losses can be attributed to the financial crisis, and that they shouldn't be held liable for marketing a variety of mortgage securities that ultimately soured. The Justice Department hasn't determined the exact timing of upcoming lawsuits, the sources said, although U.S. Attorney General Eric Holder told Reuters earlier this month that the department planned to bring more mortgage-related cases in early 2014, while declining to name which companies were targeted. The probes could also lead to settlements instead of lawsuits. The cases stem from a government task force the Obama administration created in early 2012 to probe the sale of shoddy home loans repackaged for investors.     When you are trying to buy the market's best stocks, it's worth checking up on your companies' free cash flow once a quarter or so, to see whether it bears any relationship to the net income in the headlines. That's what we do with this series. Today, we're checking in on Higher One Holdings (NYSE: ONE  ) , whose recent revenue and earnings are plotted below.

    One under-$10 business services player that looks poised for a run higher is Higher One (ONE), which provides technology-based refund disbursement, payment processing and data analytics services to higher education institutions and students. It also provides banking services to campus communities. This stock has been hit hard by the bears so far in 2013, with shares down by 26%.

    If you take a look at the chart for Higher One, you'll notice that this stock has been downtrending badly for the last three months, with shares plunging from its high of $11.93 to its recent low of $6.97 a share. During that downtrend, shares of ONE were consistently making lower highs and lower lows, which is bearish technical price action. That said, shares of ONE have recently formed a double bottom chart pattern at $7.05 to $6.97 a share. This stock has now started to rebound sharply off that double bottom and move within range of triggering a near-term breakout trade.

    Traders should now look for long-biased trades in ONE if it manages to break out above some near-term overhead resistance at $7.85 a share and then once it clears its 50-day moving average at $8.11 a share with high volume. Look for a sustained move or close above those levels with volume that hits near or above its three-month average action of 196,360 shares. If that breakout triggers soon, then ONE will set up to re-test or possibly take out its next major overhead resistance levels at $9 to its 200-day moving average of $9.77 a share. This stock could even tag $11 a share if that 200-day gets taken out with volume.

    Traders can look to buy ONE off weakness to anticipate that breakout and simply use a stop that sits right below some key near-term support at $7.39 a share, or below $7 a share. One can also buy ONE off strength once it takes out those breakout levels with volume and then simply use a stop that sits a comfortable percentage from your entry point.
